BCDR Commences Implementation of Remote Litigation

The Bahrain Chamber for Dispute Resolution (BCDR) welcomes the issuance of Decision No. (27) of 2026 by His Excellency the Minister of Justice, Islamic Affairs and Waqf, regulating remote litigation procedures for disputes within its court’s jurisdiction. This Decision marks an important step in advancing digital transformation and enhancing the judicial framework in the Kingdom of Bahrain.

The Decision represents a significant step toward enhancing the efficiency and flexibility of litigation processes, allowing case management and court hearings to be conducted fully or partially through approved audiovisual communication technologies, whether from within or outside the Kingdom. This contributes to facilitating access to justice and expediting dispute resolution.

The Decision also establishes a comprehensive procedural framework for remote litigation, including the electronic submission of pleadings and documents, remote witness examination, and the management of hearings in accordance with approved regulations, while preserving due process guarantees and the principles of a fair trial.

BCDR reaffirms its commitment to adopting international best practices in delivering advanced judicial services, further strengthening Bahrain’s legal and investment environment.

Commenting on the development, Mr. Ahmed Husain, Chief Executive Officer of BCDR, stated:
