Extent of Recognition by the Bahraini Court of Cassation of the GCC Commercial Arbitration Centre

ABSTRACT

This article describes the establishment, jurisdiction and rules of procedure of the GCC Commercial Arbitration Centre. The article also examines the Bahraini Court of Cassation’s trend towards recognizing arbitral awards issued by the GCC Commercial Arbitration Centre. The article then identifies two judgments issued by the Court on 12 March 2012 and on 2 April 2012 and discusses the main legal principles on which the Court based its judgments, particularly its consideration that the Centre is an entity independent from the Kingdom of Bahrain irrespective of its location in Bahrain. Moreover, the article addresses how the Centre’s arbitral awards are executed in the Kingdom of Bahrain.
